These Terms of use (the "Terms") govern access to and use of the prestafy.fr website (the "Site") and, where applicable, of the Prestafy (demo) application (the "Demo App").
1) Site publisher
The Site and the Demo App are published by PRESTAFY, a Société par Actions Simplifiée with share capital of €1,000, whose registered office is at 39 Rue de Jouy, 77970 Bannost-Villegagnon, France, registered with the Melun trade register under no. 105 356 794 (hereinafter "Prestafy"). All legal information is set out in the Legal notice.
2) Purpose
The Site presents the Prestafy project and allows visitors to explore its features, in particular through demonstration content and/or services.
3) Access to the Site and the Demo App
Access to the Site is free.
The Demo App is provided for demonstration purposes and may be modified, suspended or withdrawn at any time.
4) Demonstration, trial and service activation
The Site and the Demo App present Prestafy for demonstration purposes. The information displayed (examples, screenshots, features, any prices) is indicative and may change.
The service intended for merchants is provided by the Prestafy platform and a PrestaShop module installed on the merchant's store.
Where a free trial is offered when subscribing to a paid plan, it applies on the following terms:
- the trial starts on the day of subscription and lasts for the period stated at the time of subscription;
- a bank card is requested at subscription, and no amount is charged during the trial;
- at the end of the trial, the subscription continues automatically and the price of the chosen plan is charged every month;
- during the trial, the merchant may change plan or cancel at any time from their account, free of charge; the plan then remains available until the end of the trial;
- the trial is offered only once per store and per account, and requires a store connected to the service.
The commercial terms applicable to the paid subscription (price, payment terms, duration, termination, right of withdrawal) are specified at the time of subscription and, where applicable, in separate Terms of Sale.
5) Intellectual property
The Site, the Demo App and all of their content (text, visuals, logos, graphic elements, code, trade marks and so on) are protected by intellectual property law.
Any reproduction, representation, adaptation or exploitation, in whole or in part, without prior written consent is prohibited.
6) Liability
Prestafy uses reasonable means to ensure access to and the proper operation of the Site and the Demo App, without warranting that they will be free of errors or interruptions.
The Site and the Demo App are provided "as is". Demonstration content may include fictitious information.
7) External links
The Site may contain links to third-party sites. Prestafy is not responsible for their content or their practices.
7a) AI assistants connected by the merchant
The merchant may connect an artificial intelligence assistant of their choice to their Prestafy account, for example Claude (Anthropic), ChatGPT (OpenAI), Le Chat (Mistral AI) or any other assistant compatible with the MCP protocol (Model Context Protocol). This connection is optional and made at the merchant's initiative: the merchant approves it on Prestafy, app by app.
The connected assistant can read the status and configuration of the approved apps, the store's catalogue, the app's statistics as totals and the aggregated results of notifications and announcements. It can prepare drafts (the app's home screen, menu, navigation bar and appearance in the Studio, notification campaigns and segments, announcements shown when the app opens, inactive automations), propose a change to an active automation, and remove an automation it prepared itself as long as it has never been turned on. It cannot publish an app or a version, send or schedule a notification, schedule, stop or delete an announcement, turn on an automation, or apply its own proposal: these actions remain the merchant's, from Prestafy. The merchant reviews each draft before publishing, turning on or sending it, and remains solely responsible for what they publish.
The assistant is a third-party service, provided by its publisher under its own terms. Prestafy does not guarantee the availability of these services or the accuracy of the content they suggest. Prestafy may suspend or withdraw assistant access at any time, in particular for security reasons.
The merchant can withdraw an assistant's access at any time from Prestafy (My account, then Connected assistants), for a single app or for all of them. Removing the connector from the assistant is not enough to cut access on Prestafy's side. The processing of data related to this connection is described in the Privacy policy.
8) Personal data
Data processing is described on the Privacy policy page.
9) Changes
Prestafy may amend these Terms at any time. The update date will be adjusted accordingly.
10) Governing law
These Terms are governed by French law. In the event of a dispute, the French courts shall have jurisdiction.
