Terms of use — Prestafy

These Terms of use (the "Terms") govern access to and use of the prestafy.fr website (the "Site") and, where applicable, of the Prestafy (demo) application (the "Demo App").
1) Site publisher
The Site and the Demo App are published by PRESTAFY, a Société par Actions Simplifiée with share capital of €1,000, whose registered office is at 39 Rue de Jouy, 77970 Bannost-Villegagnon, France, registered with the Melun trade register under no. 105 356 794 (hereinafter "Prestafy"). All legal information is set out in the Legal notice.
2) Purpose
The Site presents the Prestafy project and allows visitors to explore its features, in particular through demonstration content and/or services.
3) Access to the Site and the Demo App
Access to the Site is free.
The Demo App is provided for demonstration purposes and may be modified, suspended or withdrawn at any time.
4) Demonstration, trial and service activation
The Site and the Demo App present Prestafy for demonstration purposes. The information displayed (examples, screenshots, features, any prices) is indicative and may change.
The service intended for merchants is provided through a PrestaShop module installed on the merchant's store, once agreed.
This module makes it possible in particular:
- to connect the application to the store,
- to offer a trial period,
- and then to activate billing at the end of the trial, under the conditions agreed with the merchant at the time of activation (price, term, termination and so on).
The commercial terms applicable to the paid subscription (price, payment terms, duration, termination, right of withdrawal) are specified at the time of subscription and, where applicable, in separate Terms of Sale.
5) Intellectual property
The Site, the Demo App and all of their content (text, visuals, logos, graphic elements, code, trade marks and so on) are protected by intellectual property law.
Any reproduction, representation, adaptation or exploitation, in whole or in part, without prior written consent is prohibited.
6) Liability
Prestafy uses reasonable means to ensure access to and the proper operation of the Site and the Demo App, without warranting that they will be free of errors or interruptions.
The Site and the Demo App are provided "as is". Demonstration content may include fictitious information.
7) External links
The Site may contain links to third-party sites. Prestafy is not responsible for their content or their practices.
8) Personal data
Data processing is described on the Privacy policy page.
9) Changes
Prestafy may amend these Terms at any time. The update date will be adjusted accordingly.
10) Governing law
These Terms are governed by French law. In the event of a dispute, the French courts shall have jurisdiction.
